Cap on noneconomic damages upheld

In a 5-2 decision issued today, the Ohio Supreme Court upheld the $250,000 statutory damage cap on noneconomic compensatory damages that may be awarded against political subdivisions in tort actions. In reversing the Eight District Court of Appeals, the Court rejected claims that the damage cap violates constitutional rights to a jury trial and to equal protection.
